When asked for a comment, La Rue said, "Many people assume that all sex crimes accusations are the same; however, there are several terms associated with these types of charges. It's important to be acquainted with each to know exactly what the charges mean."

La Rue was quick to point out that Rape convictions carry severe punishments in the state of Ohio, such as prison time (which could be anywhere from 3 years in prison to life without the possibility of parole), fines, mandatory registration as a sex offender for decades, and a criminal record.

“Under the umbrella of a sex crime allegation, someone could be charged with rape, sexual battery, gross sexual imposition, importuning, unlawful sexual activity with a minor, etc. Forcible rape differs from those accusations where the accusor cannot consent by law (young child, sleeping victim, etc.) as it requires that there was force or a violent threat of force that preceded the sexual encounter,” La Rue said.

Statutory rape – (what is now known under Ohio Law as Unlawful Sexual Conduct with a Minor) is defined as sexual conduct involving penetration between an older individual and anyone between the ages of 13 and 16 – can have different outcomes depending on a multitude of circumstances, according to La Rue.

When asked to elaborate, he said, “Certain details of a statutory rape case such as the age of the victim and the other party, or the difference in age between the two can drastically lead to varying legal repercussions. That said, according to the law, even if the underage party gave consent to intercourse, it’s still considered statutory rape or under the current laws in Ohio, Unlawful Sexual Conduct with a Minor.”

La Rue mentioned that any allegation of rape should be taken seriously as a rape conviction is considered a first-degree felony in the state of Ohio, the most serious provided for by law.

When asked to explain further, he said, “The prison sentence for a rape in Ohio can vary between three to 10 years where the victim is an adult, and up to life imprisonment without possibility of parole if the victim is a minor. Such convictions can also often come with hefty fines of as much as $20,000.
